Cet article vous explique comment modifier un testament.<\/p>\n<h2>Modifier un\u00a0testament<\/h2>\n<p>Il est possible de\u00a0mettre \u00e0 jour\u00a0son testament de deux fa\u00e7ons:<\/p>\n<p>\u2013 en faisant <strong><a href=\"https:\/\/monasalehinotaire.com\/fr\/codicille\/\" target=\"_blank\" rel=\"noopener noreferrer\">un codicille<\/a>;\u00a0<\/strong><\/p>\n<p>-en faisant un <a href=\"https:\/\/monasalehinotaire.com\/fr\/testament-notarie\/\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>nouveau testament<\/strong><\/a> qui <strong>annulera et remplacera tout autre testament fait ant\u00e9rieurement<\/strong>.<\/p>\n<h2>Faire un codicille<\/h2>\n<p>Un <strong>codicille<\/strong> est acte <strong>post\u00e9rieur \u00e0 un testament<\/strong> en vue de le <strong>modifier ou de le compl\u00e9ter<\/strong>. Le codicille est une solution \u00e0 privil\u00e9gier quand les\u00a0<strong>modifications<\/strong> que vous voulez apporter \u00e0 votre testament sont mineures et peu nombreuses. Lorsque les <strong>modifications<\/strong> sont plus <strong>importantes ou nombreuses<\/strong>, il est\u00a0<strong>recommand\u00e9 de faire un nouveau testament<\/strong>.<\/p>\n<p>L\u2019existence d\u2019un codicille notari\u00e9, tout comme pour un testament notari\u00e9, est enregistr\u00e9e au <a href=\"https:\/\/www.cnq.org\/fr\/recherche-registres-testaments-mandats.html\">Registre des dispositions testamentaires et des mandats du Qu\u00e9bec<\/a> (RDTMQ). Le codicille fait devant notaire est un acte notari\u00e9 en minute conserv\u00e9 dans la vo\u00fbte du notaire. Cela permettra un rep\u00e9rage facile et \u00a0un mise en application rapide en cas de d\u00e9c\u00e8s. Le risque d\u2019\u00e9garement, de d\u00e9gradation, ou de perte du codicille est ainsi \u00e9limin\u00e9.<\/p>\n<h2>Les avantages du codicille et du testament notari\u00e9s<\/h2>\n<p>Le testament et le codicille\u00a0faits devant notaire \u00e9tant des <strong>actes authentiques<\/strong>, ils n\u2019ont pas \u00e0 \u00eatre v\u00e9rifi\u00e9s pour en assurer la validit\u00e9. Les testaments et les codicilles olographes ou faits devant t\u00e9moins\u00a0doivent \u00eatre v\u00e9rifi\u00e9s par un notaire ou un tribunal. La proc\u00e9dure de v\u00e9rification, qui vise \u00e0 s\u2019assurer que le document a \u00e9t\u00e9 fait par le d\u00e9funt, a pour effet de retarder \u00a0le r\u00e8glement de la succession. Durant la p\u00e9riode de v\u00e9rification qui peut durer quelques mois, l\u2019ensemble des actifs du d\u00e9funt seront bloqu\u00e9s. De plus, la d\u00e9marche de v\u00e9rification entra\u00eene des co\u00fbts suppl\u00e9mentaires variant de quelques centaines \u00e0 plusieurs milliers de dollars, selon la complexit\u00e9 du dossier.<\/p>\n<h2>Choisir son notaire pour mettre \u00e0 jour\u00a0son testament<\/h2>\n<p>Sachez qu\u2019il n\u2019y a pas d\u2019obligation de confier la r\u00e9daction de votre codicille au m\u00eame notaire qui a re\u00e7u votre testament initial. Vous \u00eatre libre de choisir le notaire de votre choix pour modifier un testament.
